98-12-1 PUBLIC HEARING TO CONSIDER AMENDMENTS TO THE PROPOSED "LEV II" AND "CAP 2000" AMENDMENTS TO THE CALIFORNIA EXHAUST AND EVAPORATIVE EMISSION STANDARDS AND TEST PROCEDURES FOR PASSENGER CARS, LIGHT-DUTY TRUCKS AND MEDIUM-DUTY VEHICLES, AND TO THE EVAPORATIVE EMISSION REQUIREMENTS FOR HEAVY-DUTY VEHICLES

SUMMARY OF AGENDA ITEM:

The staff proposed amendments to the California Code of Regulations (CCR), Title 13, Sections 1900, 1060.1,1968.1, 2037, 2038, 2062, 2101, 2106, 2107, 2110, 2112, 2114, 2119, 2130, 2137-2140, and 2143-2148, and to the emission standards, test procedures, and warranty requirements incorporated by reference in those sections. Staff also proposed adoption of Title 13, CCR, Sections 1961 and 1962, and incorporated test procedures. The proposed amendments include a restructuring of the light-duty truck category so that most Sport Utility Vehicles (SUVs) and pick-up trucks are subject to the same low-emission vehicle standards as passenger cars, substantially lowering the oxides of nitrogen (NOx) standard for passenger car and light- duty truck Low-Emission Vehicles (LEVs) and Ultra Low-Emission Vehicle (ULEVs), creation of a new Super Ultra Low-Emission Vehicle (SULEV) emission category for passenger cars and light-duty trucks, establishment of more stringent model year phase-in requirements for passenger cars, light-duty trucks, and medium-duty vehicles, a provision for Partial Zero- Emission Vehicle (PZEV) allowances to provide additional flexibility to manufacturers in meeting the Zero-Emission Vehicle (ZEV) requirements, multiple ZEV credits for ZEVs with extended all-electric range in the 1999-2007 model years, and more stringent evaporative emission standards and durability requirements. These amendments are applicable to 2004 and subsequent model year passenger cars, light-duty trucks and medium-duty vehicles. Staff also proposed amendments that would streamline the light-duty vehicle compliance requirements for 2001 and subsequent model years. These amendments, known as the "Compliance Assurance Program," or "CAP 2000," establish a new in-use compliance program with a greater focus on in-use compliance with emission standards. Changes proposed by staff at the Board hearing included a provision for manufacturers to earn NOx credits for the early introduction of larger trucks and SUVs meeting a 0.2 g/mi NOx emission level. These credits can be used in the 2004-2008 model years on like vehicles certifying to the 0.05 LEV and ULEV NOx standards. A provision was also included to provide SULEVs that are introduced prior to the 2004 model year with an additional in-use compliance margin. In addition, provisions were added to provide less stringent in-use compliance evaporative requirements for 2004-2006 model year vehicles meeting the new standards.

FORMAL BOARD ACTION:

Approved Resolution 98-53 adopting staff's proposal by an 11-0 vote. The resolution reflected an additional change proposed by the Board on a 7-3 vote (1 member abstaining) to eliminate the Transitional Low-Emission Vehicle (TLEV) category beginning in 2004 (which likely precludes diesels in vehicles below 8500 lbs. gross vehicle weight).
