Comment | This proposed regulation amounts to a mandated activity for no consideration which in essence is a tax. To make matters worse, it may place a serious liability on a business only due to a regulation. I represented a dealership whose insurer paid out over $5,000,000 due to lack of documentation of worn tires. I also have been involved with frivilous BP17200 lawsuits for minor code infractions. This bill places thousands of businesses at risk. There are additional risks with the complexity of the right air pressure for non-oem tires that increases the liability of the business. Repair shops are not tire shops, and should not have the expertise expectations of a dedicated tire professional. For a repair shop to become an expert for every tire, is an additional tax and burden for small business in California. While businesses are struggling to stay open to pay taxes, this bill acts as a tax on the very engine of economic growth. |
