PUBLIC HEARING TO CONSIDER CERTIFICATION AND TEST PROCEDURES FOR VAPOR RECOVERY SYSTEMS

At its June 24, 1999, public hearing, the Air Resources Board (the "Board") approved the amendment of sections 94011, 94153, 94154, and 94155, Title 17, California Code of Regulations (CCR), which incorporate by reference the following certification and test procedures for vapor recovery systems:
"CP-201" - Certification Procedure for Vapor Recovery Systems of Dispensing Facilities
"TP-201.4" - Determination of Dynamic Pressure Performance of Vapor Recovery Systems of Dispensing Facilities
"TP-201.5" - Determination (by Volume Meter) of Air to Liquid Volume Ratio of Vapor Recovery Systems of Dispensing Facilities
"TP-201.6" - Determination of Liquid Removal of Phase II Vapor Recovery Systems of Dispensing Facilities
At the hearing the staff presented, and the Board approved, modifications to the regulations originally proposed in the Staff Report released on May 7, 1999, in response to continuing review and comments received since the Staff Report was published. The modifications affect the text of certification and test procedures CP-201, TP-201.4, TP-201.5 and TP-201.6.
Modifications to CP-201
As originally noticed, CP-201 section 3.1.2 (10) proposed that an applicant for certification notify all component manufacturers of the applicant's intended use of the component manufacturers' equipment when the applicant was not the manufacturer of all system components. As modified, CP-201 section 3.1.2 (10) would require notification as follows: When the applicant is requesting inclusion of one or more components on an already certified system, the applicant shall notify the manufacturers, if any, named as the applicant or holder of the executive order for the certified system. When the applicant is requesting certification of one or more components as part of a new system, the applicant shall notify all manufacturers.
As originally noticed, CP-201 section 3.2.2 proposed changing the one-year warranty period of vapor recovery system equipment. As modified, CP-201 section 3.2.2 would retain the warranty period of one year as provided in the regulations currently in place.
As originally noticed, CP-201 did not provide for a "warranty notice tag." The proposed modification adds a requirement for warranty notice tags on certified equipment and specifies information that is to be included on the warranty notice tag.
Modifications to TP-201.4
As originally noticed, TP-201.4 was not explicitly inapplicable to vapor assist type vapor recovery systems. Modifications in section 1 make this inapplicability clear.
As originally noticed, TP-201.4 provided ambiguous and incorrect specifications for test apparatus and its performance. Modifications in sections 5.1, 5.3 and 6.3 clarify and correct these specifications and require a check of the apparatus' backpressure.
As originally noticed, TP-201.4 did not specify opening all Phase I poppet valves and contained unneeded wording regarding rags. Modifications to section 7.3.6 require all Phase I poppets to be opened and delete reference to rags.
As originally noticed, TP-201.4 requirements for adding gasoline to underground piping were not specific. Modifications to section 7.3.3 clarify these requirements.
Modifications to TP-201.5
As originally noticed, TP-201.5 lacked an explicit prohibition of draining hoses prior to testing. Such a requirement has been added in section 4.6.
As originally noticed, TP-201.5 did not include a requirement for electrical grounding. This requirement has been added in section 5.
As originally noticed, TP-201.5 required a particular type of volume meter or its equivalent. Other volume meters which meet the performance specifications will be allowed by the modifications in section 7.3.
As originally noticed, TP-201.5 fillpipe specifications were unclear. Clarification of tank fillpipe specifications has been added in section 7.6.1.
As originally noticed, TP-201.5 was silent on the acceptability of state and county calibration procedures. Modifications provide for acceptance of appropriate state and county calibration procedures in section 8.1.
As originally noticed, TP-201.5 leak check requirements and requirements related to facility pressure/vacuum (P/V) and Phase I poppet valve position were unclear. Modifications in section 9 include clarification of leak check requirements and requirements related to facility P/V and Phase I poppet valve positions.
As originally noticed, TP-201.5 did not prohibit system adjustments during testing. Prohibition of system adjustments during testing has been added in section 10.1.8.2.
As originally noticed, TP-201.5 did not require a sufficient number of test runs in certification testing. The addition of section 10.2 will provide for an increase in the number of runs required in certification testing.
Modifications to TP-201.6
As originally noticed, TP-201.6 might have been considered applicable to vapor assist type vapor recovery systems. Modifications to section 1 make the procedure explicitly inapplicable to vapor assist type vapor recovery systems.
Minor Editorial Corrections
In addition to changes approved by the Board, minor editorial corrections have been made by staff in the following procedures: TP-201.4 section 7.3.3.1 and TP-201.5 sections 8.1, 9.7, and 10.13.
Board Resolution 99-23 sets forth the Board's action approving Title 17, California Code of Regulations, sections 94011, 94153, 94154, and 94155, and approving the amendment of the incorporated certification and test procedures for vapor recovery systems, CP-201, TP-201.4, TP-201.5, and TP-201.6, as modified. The Resolution and the text of the regulations and incorporated test methods, as modified, are available on the Board's Web site at http:://www.arb.ca.gov/regact/vapor/vapor99/vapor99.htm. In accordance with section 11346.8 of the Government Code, the Board directed the Executive Officer to adopt sections 94011, 94153, 94154, and 94155, Title 17, California Code of Regulations, and the incorporated certification and test procedures for vapor recovery systems, CP-201, TP-201.4, TP-201.5, and TP-201.6, as modified, after making them available to the public for comment for a period of at least 15 days. The Board further provided that the Executive Officer shall consider such written comments as may be submitted during this period, shall make such modifications as may be appropriate in light of the comments received, and shall present the regulations to the Board for further consideration if warranted.
Written comments on the modifications approved by the Board must be submitted to the Clerk of the Board, Air Resources Board, P.O. Box 2815, Sacramento, California 95812, no later than September 14, 1999, for consideration by the Executive Officer prior to final action. Only comments relating to the above-described modifications to the regulations shall be considered by the Executive Officer.
