Notice of Public Availability of Modified Text

PUBLIC HEARING TO CONSIDER THE ADOPTION OF AMENDMENTS TO THE LOW-EMISSION VEHICLE REGULATIONS, INCLUDING PARTICULATE STANDARDS FOR GASOLINE VEHICLES, MORE STRINGENT EMISSION STANDARDS FOR FUEL-FIRED HEATERS, AND ADMINISTRATIVE REVISIONS

At a public hearing held November 15, 2001, the Air Resources Board (the Board or ARB) approved amendments to sections 1960.1, 1960.5, 1961 and 1962, title 13, California Code of Regulations (CCR), and amendments to or adoption of five ARB documents incorporated by reference in those sections. The amendments will establish particulate matter standards for gasoline vehicles, require multi-fuel vehicles receiving partial zero-emission vehicle credit to certify to super-ultra-low-emission vehicle (SULEV) standards on both the alternative fuel and gasoline, and make a number of administrative revisions.

The Board's action. At the conclusion of the hearing, the Board adopted Resolution 01-51, in which it approved the originally proposed amendments with modifications in two areas. These modifications had been suggested by staff in response to public comments made to staff after issuance of the original proposal. The text of the suggested modifications was contained in a 10-page document titled "Staff's Suggested Modifications to the Original Proposal," which was distributed at the hearing and was Attachment G to the Resolution. The Resolution and its Attachment G are attached to this Notice. The Resolution directed the Executive Officer to make the modified text available for a supplemental comment period.

The approved modifications will establish new fleet average non-methane organic gas phase-in requirements for independent low volume manufacturers and delete the proposed requirement that fuel-fired heaters used in zero-emission vehicles meet SULEV standards when tested at 40oF.

Modified text being made available. The attached Attachment G to the Resolution contains the text of all of the proposed modifications to sections 1961 and 1962, title 13, CCR, and the modified portions of the following incorporated documents:

"California Exhaust Emission Standards and Test Procedures for 2001 and Subsequent Model Passenger Cars, Light-Duty Trucks and Medium-Duty Vehicles," incorporated by reference in section 1961(d), title 13, CCR; and

"California Exhaust Emission Standards and Test Procedures for 2003 and Subsequent Model Zero-Emission Vehicles, and 2001 and Subsequent Model
Hybrid Electric Vehicles, in the Passenger Car, Light-Duty Truck and Medium-Duty Vehicle Classes," incorporated by reference in section 1962(e), title 13, CCR.

Comments and subsequent action. In accordance with section 11346.8 of the Government Code, the Board's Resolution directed the Executive Officer to amend sections 1961 and 1962, title 13, CCR, and amend the incorporated documents, after making the text of the modifications available to the public for comment for a period of at least 15 days. The Board further provided that the Executive Officer shall consider such written comments regarding the modified text that may be submitted during this period, shall make modifications as may be appropriate in light of the comments received, and shall present the regulations to the Board for further consideration if warranted.

Only comments relating to the modifications to the text of the regulations or incorporated Test Procedure documents will be considered by the Executive Officer.
